The Digital Hub has obligations under the Freedom of Information Act 2014, the European Communities (Access to Information on the Environment) Regulations 2007 and Data Protection legislation, including the General Data Protection Regulation (EU) 2016/679 and the Data Protection Acts 1988 – 2018.

Below you will find information on how to contact the organisation should you wish to make a request pursuant to the above pieces of legislation.

Freedom of Information

The Freedom of Information Act 2014 gives you the legal right to request access to records held by the Digital Hub. Our Freedom of Information Publication Scheme may be useful to members of the public seeking to find out information about the Digital Hub. It can be found here.

When making a request for information under the Freedom of Information Act, you are required to:

  • state that the application is being made under the Freedom of Information Act and submit it in writing or electronic form;
  • provide your contact details;
  • state, in terms that are as specific as possible, the information being requested, and
  • if you require the information in a specific format or manner of access, you should specify this in your request.

Access to Information on the Environment

The European Communities (Access to Information on the Environment) Regulations 2007 to 2014 give legal rights to those seeking to access information on the environment from public authorities.

When making a request for information under the Access to Information on the Environment Regulations, you are required to:

  • state that the application is being made under the Access to Information on the Environment Regulations and submit it in writing or electronic form;
  • provide your contact details;
  • state, in terms that are as specific as possible, the environmental information being requested, and
  • if you require the information in a specific format or manner of access, you should specify this in your request.

Data Protection Acts and General Data Protection Regulations

The Data Protection Acts and the General Data Protection Regulation (GDPR) provide similar rights of access to personal data as the Freedom of Information Acts, the main difference being that the Data Protection Acts/GDPR do not apply to records of deceased persons.

When making a request to access your personal data under the Data Protection Act 2018 and the General Data Protection Regulations, you are required to:

  • state that the application is being made under the Data Protection Acts/GDPR and submit it in writing or electronic form;
  • provide your contact details;
  • state, in terms that are as specific as possible, the personal data you are requesting access to, and
  • if you require the information in a specific format or manner of access, you should specify this in your request.

FOI Publication Scheme

To comply with the Freedom of Information (FOI) Act 2014, the Digital Hub Development Agency publishes as much information as possible in an open and accessible manner on a routine basis, having regard to the principles of openness, transparency and accountability as set out in the Act. The Digital Hub Development Agency’s ‘Publication Scheme’ will:

  • Allow public access to information held by the Digital Hub Development Agency
  • Publish the reasons for decisions made by the Digital Hub Development Agency under FOI
  • Publish information of relevance or interest to the public in relation to the Digital Hub Development Agency activities and functions generally

Information available on this website provides general information about the Digital Hub Development Agency, its functions and services, its decision-making procedures, its finances, including procurement, and other miscellaneous information.

The Digital Hub Development Agency must publish a log of the freedom of information requests it receives and include information on the records / information sought and the decision made by The Digital Hub Development Agency on the release of the documentation / information. The Digital Hub Development Agency updates the log of FOI requests on a quarterly basis and posts them to the Publications page of this website.

FOI and AIE Fees and Charges

Is there a charge for making a FOI or AIE request?

There is no charge for submitting a request. Fees are considered where a request covers a large volume of information / records. Charges may be applied for search and retrieval and for any reproduction costs in providing you with the material requested. Where the cost of such search, retrieval and duplication:

  • Is less than €101, no fee is charged
  • Is greater than €500 but less than €700, a maximum charge of €500 applies
  • Is greater than €700, the Digital Hub Development Agency can refuse to process the request

Details of the actual charges relating to your request will be notified to you in writing. Payment should be made by way of Electronic funds transfer.

  • Search and retrieval: €20.00 per hour
  • Copying charges: Photocopy per sheet: €0.04 / USB key: €10.00

Appeals

  • Internal Review fee costs €30 (€10 for medical card holders)
